Text Messages
We and our business associates, including vehicle dealers, may send text messages that you have consented to receive. Text frequency may vary. You can cancel text messages at any time by texting “STOP.” After you send “STOP”, we may send you an additional text message to confirm that you have been unsubscribed. You will no longer receive text messages from that short code or number, as applicable, but you may receive text messages if you are subscribed to other text lists. If at any time you have questions about the text messages, text “HELP.” After you send “HELP”, we will respond with instructions on how to unsubscribe. Message and data rates may apply.
In addition, our current and potential business associates, including Business Employees, may receive text messages via the Zoom mobile application. By subscribing to CARFAX Services and providing a mobile number, you consent to CARFAX’s use of the Zoom application to text you. By enrolling in a Program, you provide your prior express written consent to receive recurring marketing or transactional Text Messages from CARFAX and its service providers. Your consent is Program-specific. Enrolling in one Program does not constitute enrollment in any other Program.
You acknowledge and agree that Text Messages you receive from CARFAX and its service providers may be sent using an automatic telephone dialing system or other automated technology (e.g., autodialer and prerecorded technology). Consent to receive Text Messages is not a condition of purchasing any goods or services. You represent and warrant to CARFAX that you are the account holder or customary user of the mobile phone number you provide to CARFAX.
3. Text Message Frequency & Rates
Text Message frequency varies based on the specific Program. Standard message and data rates may apply for Text Messages. You are responsible for any fees charged by your mobile carrier. Marketing Text Messages will be sent between 8:00 AM and 8:00 PM local time based on your provided area code.

You may revoke your consent to receive Text Messages from CARFAX at any time. To opt out of a Program, text STOP to the specific short code or phone number associated with that Program (e.g., text STOP to 227329). Following your “STOP” request, we may send you an additional Text Message to confirm that you have been unsubscribed from such Program. This additional Text Message will not contain marketing content and represents the final communication from that specific Program.
5. Re-enrollment
To re-enroll into a Program you previously opted out of, you must follow the original enrollment instructions for that Program or text “START” to the specific short code or phone number associated with that Program.
6. Customer Support
If at any time you have questions about Text Messages, text “HELP” to the short code or phone number associated with the applicable Program. After you text “HELP”, we will respond with instructions on how to unsubscribe. 10. Privacy and Third Parties
CARFAX will never share your personal information collected through Text Messages with third parties for their own marketing purposes.
11. Intellectual Property
Text Messages may contain or reference CARFAX trademarks or other intellectual property of CARFAX. These Text Messages do not grant you any rights to use CARFAX trademarks or other intellectual property.
12. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, ALL TEXT MESSAGE CONTENT IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. CARFAX EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
13. Limitation of Liability; Indemnification
To the fullest extent permitted by law, CARFAX is not liable for any direct, indirect, or consequential loss or damages related to your receipt, use of, or inability to use or receive Text Messages.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless CARFAX, its affiliates, service providers, and mobile carriers, and each of their respective officers, directors, employees, agents, and representatives (collectively, the “Indemnified Parties”), from and against any and all claims, causes of action, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to your failure to provide timely notice of a change or deactivation of your mobile phone number, your provision of a mobile phone number for which you are not the account holder or customary user, or any breach of these Terms.
14. Termination by CARFAX
CARFAX may, in its sole discretion, terminate or suspend your enrollment in any Program at any time, with or without cause, and without prior notice to you. CARFAX also reserves the right to modify, sunset, or discontinue any Program or any part thereof at any time.
